Agreement
These Terms of Service ("Terms") govern your access to and use of AriHum websites, mobile apps, AI health companion features, document analysis, subscriptions, exports, notifications, and related services (the "Services"). "AriHum", "we", "our", and "us" mean Forcapedia, operating the AriHum product as a brand, based in India, and any entity through which AriHum services are provided ("AriHum Health"). By using AriHum, creating an account, starting a trial, purchasing a subscription, or continuing after a Terms update, you agree to these Terms.
Read with privacy policy
Our Privacy Policy explains how we collect, use, share, and protect personal and health information. It is part of the overall agreement between you and AriHum. If you do not agree to these Terms or the Privacy Policy, do not use the Services.
Eligibility
AriHum is not intended for people under 18. You may use AriHum only if you are at least 18 years old, can form a binding contract, and are not barred from using the Services under applicable law.
If you use AriHum to organize information for a family member, dependent, or another person, you represent that you have the legal right and consent required to submit that person's information and to receive AI-generated information about it.
What AriHum provides
AriHum is an AI-powered health information companion. Depending on your plan and region, AriHum may:
- Answer health questions using AI-generated educational information.
- Ask clarifying questions before responding.
- Remember health context that you provide across sessions.
- Analyze uploaded lab reports, prescriptions, images, PDFs, and other health documents.
- Generate summaries, trends, reports, suggested questions, and export files.
- Send reminders, check-ins, and notifications if you enable them.
Not medical advice
AriHum provides general health information for educational and informational purposes only. AriHum does not provide medical advice, diagnosis, treatment, prescriptions, dose changes, professional medical judgment, or clinical care.
No doctor-patient, clinician-patient, therapist-patient, pharmacist-patient, or other professional healthcare relationship is created by using AriHum.
Use professionals
Always consult a qualified licensed healthcare professional before making decisions about symptoms, diagnosis, medication, dosage, diet, supplements, treatment, test results, or any medical condition. Do not ignore, delay, or replace professional medical advice because of anything AriHum says.
Emergencies
AriHum is not designed for emergencies and cannot contact emergency services for you. If you may be experiencing an emergency, including chest pain, difficulty breathing, stroke symptoms, severe allergic reaction, loss of consciousness, suicidal thoughts, overdose, severe hypoglycemia, or any other urgent condition, stop using AriHum and call your local emergency number immediately, such as 911 in the United States, 112 in many countries, or your local emergency service.
AI limitations
You understand and agree that:
- AI outputs may be inaccurate, incomplete, outdated, inconsistent, or inappropriate for your specific situation.
- AI may misunderstand your message, medical document, symptoms, units, reference ranges, images, language, or context.
- Medical knowledge, clinical guidelines, drug labels, and local standards of care can change.
- Uploaded documents may be blurry, incomplete, incorrectly extracted, mistranslated, or missing important information.
- AriHum may provide suggestions for discussion with a professional, but those suggestions are not professional medical instructions.
No medical device claim
Unless expressly stated in writing for a specific regulated product or region, AriHum is not a medical device and is not approved, cleared, registered, or certified by regulators such as the FDA, EMA, MHRA, CDSCO, or any other medical-device authority. AriHum is not intended to diagnose, cure, mitigate, treat, or prevent disease.
Third-party AI and APIs
AriHum uses third-party AI model providers, document-processing services, hosting, storage, subscription, analytics, crash-reporting, email, notification, and other service providers to operate the Services. Your prompts, health context, files, extracted data, and AI outputs may be processed by those providers as needed to provide AriHum. We do not own the underlying third-party AI models, and we cannot guarantee that any model output will be error-free.
Your information
You are responsible for:
- Providing accurate, current, and complete information.
- Reviewing AI outputs before relying on them.
- Using your own judgment and consulting qualified professionals.
- Not submitting information you are not legally allowed to submit.
- Keeping your account credentials, devices, and app-store accounts secure.
Acceptable use
You agree not to:
- Use AriHum for unlawful, harmful, abusive, deceptive, discriminatory, or unsafe purposes.
- Use AriHum to provide medical services to others, operate a clinical practice, or make professional healthcare decisions unless we expressly authorize that use in writing.
- Use AriHum for emergencies, crisis response, or situations requiring immediate professional care.
- Upload malware, harmful code, illegal content, or content that violates another person's rights.
- Attempt to bypass safety systems, rate limits, subscription limits, authentication, access controls, or content protections.
- Reverse engineer, scrape, crawl, copy, resell, benchmark for a competing product, or use AriHum to train competing models or services without written permission.
- Share your account, impersonate another person, misrepresent information, or interfere with the Services.
Uploads and user content
You keep ownership of the information, messages, files, images, documents, and other content you submit to AriHum ("User Content"). You grant AriHum a worldwide, non-exclusive, royalty-free license to host, process, reproduce, analyze, transform, transmit, display, and create outputs from User Content solely to provide, secure, support, improve, and operate the Services as described in these Terms and the Privacy Policy.
AI outputs
Subject to these Terms and applicable law, you may use outputs generated for you by AriHum for personal, non-commercial health organization and discussion with healthcare professionals. You are responsible for verifying outputs before using, sharing, or relying on them. Outputs may not be unique and similar outputs may be generated for other users.
Plans and billing
AriHum may offer free trials, paid subscriptions, usage limits, regional pricing, and plan-based features. Pricing, plan features, limits, and availability may vary by country, app store, currency, device, promotion, and subscription provider.
- Trials automatically convert to paid subscriptions unless cancelled before the trial ends, as disclosed at purchase.
- Subscriptions renew automatically unless cancelled according to the app store or payment provider rules.
- Subscriptions are billed through Apple App Store or Google Play. Refunds, cancellations, chargebacks, and payment disputes are handled according to the rules of the relevant app store. AriHum does not process refunds directly for purchases made through app stores. If you believe a charge is incorrect, contact the app store where you purchased. For direct billing disputes not handled by an app store, contact us at hello@arihum.com within 30 days of the charge.
- Deleting the AriHum app or deleting your AriHum account may not automatically cancel a subscription billed through an app store.
- We may change plans, prices, features, or limits with notice where required by law. Existing subscriptions will be handled according to applicable app-store or provider rules.
Account deletion
You may delete your account through the app where available or by contacting us. Account deletion is described in our Delete Account Policy. We may retain limited information where required or permitted for legal, tax, billing, fraud-prevention, safety, security, dispute-resolution, or enforcement reasons.
Availability
AriHum may be unavailable, delayed, interrupted, inaccurate, or modified from time to time. We may suspend, limit, change, remove, or discontinue features, providers, plans, regions, or access where necessary for security, compliance, maintenance, provider limitations, product changes, or business reasons.
Regional restrictions
You may use AriHum only where it is lawful for you to do so. Some features may not be available in every country, language, or region. Mandatory local consumer, privacy, health, or app-store laws may give you rights that these Terms cannot limit.
Third-party services
AriHum may link to or interoperate with third-party services, app stores, identity providers, payment processors, subscription managers, AI providers, email services, notification services, analytics tools, or websites. Third-party services are governed by their own terms and privacy policies. AriHum is not responsible for third-party services except where applicable law says otherwise.
App stores
If you download AriHum through Apple App Store, Google Play, or another app store, your use may also be subject to that store's terms. The app store provider is not responsible for AriHum's content, support, health information, or claims, except as required by its own terms or applicable law.
Intellectual property
AriHum, including its software, design, text, graphics, interface, branding, trademarks, workflows, prompts, compilations, and other materials, is owned by AriHum or its licensors and is protected by intellectual-property laws. Except for the limited right to use the Services under these Terms, no rights are transferred to you.
Feedback
If you send ideas, feedback, bug reports, suggestions, or other comments, you grant AriHum the right to use them without restriction or compensation, provided we do not identify you publicly without your consent.
Disclaimers
To the maximum extent permitted by law, AriHum is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant that AriHum will be accurate, complete, reliable, secure, uninterrupted, error-free, suitable for your condition, or available in any particular location.
Liability limits
To the maximum extent permitted by law, AriHum and its owners, officers, directors, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for health decisions, medical outcomes, lost data, service interruption, or reliance on AI outputs. Where liability cannot be excluded, it is limited to the greater of the amount you paid AriHum for the Services in the three months before the claim or USD 100, unless applicable law requires a different limit.
Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless AriHum and its owners, officers, directors, employees, contractors, affiliates, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your User Content, your misuse of AriHum, your violation of these Terms, your violation of law, or your violation of another person's rights.
Termination
You may stop using AriHum at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk, failed to pay, misused the Services, or if we must do so for legal, safety, security, provider, or business reasons. Termination does not automatically cancel subscriptions managed by an app store unless that store confirms cancellation.
Changes to terms
We may update these Terms as AriHum, our providers, or applicable laws change. If changes are material, we will provide notice as required by law, such as in the app, on the website, or by email. Continued use after the updated Terms take effect means you accept the updated Terms.
Disputes
If you have a concern, contact us first so we can try to resolve it informally. These Terms are intended to apply globally, while preserving any mandatory rights you have under local consumer, privacy, health, or app-store laws.
Except where mandatory local law requires otherwise, these Terms are governed by the laws of India, without regard to conflict-of-law rules. Disputes will be subject to the exclusive jurisdiction of the competent courts in India, unless mandatory local law in your region requires a different forum. Nothing in these Terms limits rights that cannot be waived under applicable law, including rights under the Indian Consumer Protection Act 2019 or the Digital Personal Data Protection Act 2023.
